The Tennessee Supreme Court will hear two cases on November 7, 2018, in Jackson, Tennessee. The details of the cases are as follows:
Wednesday, November 7, 2018
- Gerald Stanley Green v. Board of Professional Responsibility.–Gerald Stanley Green, a licensed Tennessee attorney, is challenging a decision imposing a six-month suspension from the practice of law of Mr. Green, with thirty days to be served as an active suspension and the remainder to be served on probation. The Shelby County Chancery Court affirmed the decision of the hearing panel of the Board of Professional Responsibility, and Mr. Green then filed a notice of appeal with the Tennessee Supreme Court. On appeal, Mr. Green argues that the hearing panel’s decision regarding his violations of the Tennessee Rules of Professional Conduct was arbitrary and capricious and not supported by substantial and material evidence. He also argues that a suspension is not the appropriate discipline in this case.
- Carlos Eugene Moore v. Board of Professional Responsibility. – Carlos Eugene Moore, a licensed Tennessee attorney, is appealing the decision of the trial court which in turn affirmed the decision of a hearing panel imposing a sanction of a public censure for violations of the Tennessee Rules of Professional Conduct. On appeal to this Court, Mr. Moore challenges the hearing panel’s decision both as to the violations of the Rules of Professional Conduct and to the imposition of a public censure as arbitrary and capricious and not supported by substantial and material evidence.
